AGB – Allgemeine Geschäftsbedingungen NewRoots Brazilian Dance repräsentiert von Miguel Gomes Bezerra
1. Geltungsbereich
1.1 Unsere allgemeinen Geschäftsbedingungen gelten für alle von Miguel Gomes Bezerra – im Weiteren auch Tanzlehrer genannt – geplanten und / oder durchgeführten Veranstaltungen innerhalb der Bundesrepublik Deutschland.
2. Anmeldung, Laufzeit
2.1 Die Anmeldung zu einer Veranstaltung erfolgt per elektronischer Datenübermittlung über das Anmeldeformular. Mit Abgabe oder Übersendung der Anmeldung kommt es zum Vertragsschluss.
2.2 Der Vertrag wird zunächst für die Dauer von dem gewählten Vereinbarungszeitraum (1 Monat; 3 Monate – Trimester; 6 Monate – Semester) geschlossen. Der Vertrag verlängert sich jeweils automatisch um den gleichen Zeitraum, sofern er nicht unter Einhaltung der Kündigungsfrist vor dem jeweiligen Beendigungszeitpunkt gekündigt wird.
2.3 Bei minderjährigen Personen muss die Anmeldung vom Erziehungsberechtigten durchgeführt werden.
2.4 Eine Anmeldebestätigung erfolgt ebenfalls elektronisch per E-Mail.
3. Kündigung
3.1 Die Kündigung muss unter Einhaltung der Kündigungsfrist von 14 Tagen (maßgeblich ist das Eingangsdatum) elektronisch per Email an [email protected] erfolgen.
3.2 Bei außergewöhnlichen Umständen (z.B. coronabedingter Lockdown) sowie bei nachgewiesener Krankheit und vergleichbaren Verhinderungsgründen des Teilnehmers kann der Vertrag für eine Zeit ausgesetzt werden. Die Vertragslaufzeit verlängert sich um die Dauer der Aussetzungszeiten. Eine solche Unterbrechung des Vertrags kann elektronisch per E-Mail an [email protected] beantragt werden.
4. Haftung
4.1 Jeder Teilnehmer nimmt auf eigene Verantwortung am Unterricht teil. Die Kursleitung haftet nicht für entstandene Personen- und/oder Sachschäden. Von dem Bestehen einer Haftpflicht- und Unfallversicherung wird ausgegangen. Die Haftung des Tanzlehrers ist somit ausgeschlossen, es sei denn die Schadensursache geht mit einer Verletzung der Aufsichtspflicht einher und beruht auf Vorsatz und/oder grober Fahrlässigkeit. Für die Garderobe bzw. anderweitige Wertgegenstände haftet der Teilnehmende selbst.
5. Zahlungsbedingungen
5.1 Die Teilnahme an Kursen wird dem Teilnehmer gegen das entsprechende Entgelt gewährt:

5.2 Nichtteilnahme, vorzeitiger Abbruch sowie die nicht Inanspruchnahme der gesamten Unterrichtsstunden entbinden nicht von der Leistung der gesamten Kursgebühr. Die Berechtigung zur Kursteilnahme ist nicht auf Dritte übertragbar.
5.3 Bei einem Vereinbarungszeitraum von 6 Monaten (Semester) erhält der Teilnehmer Ermäßigungen für von Miguel Gomes Bezerra organisierte Veranstaltungen (Workshops und Partys in Hamburg und Umgebung). Diese Veranstaltungen werden auf Flyern und anderen Werbematerialien entsprechend gekennzeichnet. Die Ermäßigungen gelten nicht für Veranstaltungen, bei denen Miguel Gomes Bezerra mitwirkt, jedoch nicht alleiniger Hauptveranstalter ist.
5.4 Zwischen Weihnachten und Neujahr finden keine Tanzkurse statt. Der Zeitraum der Sommerpause kann von Jahr zu Jahr abweichen. Die Termine werden vom Tanzlehrer rechtzeitig kommuniziert. An gesetzlichen Feiertagen findet in der Regel kein Unterricht statt.
5.5 Der Tanzlehrer behält sich vor, geplante Tanzkurse in notwendigen Fällen ausfallen oder vertreten zu lassen sowie bei zu geringen Kursanmeldungen (weniger als 3 Paare) ausfallen zu lassen.
5.6 Der Monatsbeitrag ist jeweils zum spätestens 5. eines Monats fällig.
5.7 Der Betrag ist entweder über das Zahlungssystem der Webseite www.newroots.com.br zu entrichten oder auf das folgende Konto zu überweisen:

5.8 Gerät der Teilnehmer ohne guten Grund in Zahlungsverzug, wird der Vertrag zum Ende des gültigen vereinbarten Zeitraums gekündigt.
6. Sonstiges
6.1 Es wird keine Garantie dafür übernommen, dass der Teilnehmer einen Tanzpartner hat.
6.2 Es erfolgt keine Beitragsrückzahlung bei schuldhafter Nichtteilnahme an einzelnen Kursterminen.
6.3 Der Teilnehmer erteilt seine Einwilligung, dass getätigte Foto- und Videoaufnahmen bei den Tanzkursen und Tanzpartys veröffentlicht werden dürfen.
7. Datenschutz
7.1 Wie gesetzlich vorgeschrieben, verwenden wir Daten ausschließlich intern. Es erfolgt keine Weitergabe an Dritte sowie kein Verkauf!
Auch werden grundsätzlich keine Telefonnummern, Emails oder sonstige Daten der Teilnehmer an andere Teilnehmer herausgegeben.
8. Inkrafttreten
8.1 Mit Absendung eines Anmeldeformulars in elektronischer Form (Anmeldeformular) oder bei der Teilnahme einer sonstigen von Miguel Gomes Bezerra geplanten oder durchgeführten Veranstaltung werden diese Geschäftsbedingungen ausdrücklich zur Kenntnis genommen und bindend anerkannt.

1. validity of the terms and conditions
1.1 Our general terms and conditions apply to all events planned and / or performed by Miguel Gomes Bezerra – further also called dance teacher – within the Federal Republic of Germany.
2. Registration, Duration
2.1 The registration for an event is made by electronic data transmission via the registration form. The contract is concluded upon submission or transmission of the registration.
2.2 The contract is initially concluded for the duration of the selected agreement period (1 month; 3 months – trimester; 6 months – semester). The contract shall be automatically renewed for the same period, unless it is terminated before the respective termination date in compliance with the notice period.
2.3 In the case of minors, the registration must be carried out by the parent or legal guardian.
2.4 A confirmation of registration will also be sent electronically by e-mail.
3. Cancellation
3.1 Cancellation must be made electronically by email to [email protected], in compliance with the cancellation period of 14 days (the date of receipt is decisive).
3.2 In case of extraordinary circumstances (e.g. corona-related lockdown) as well as proven illness and comparable reasons for prevention of the participant, the contract can be suspended for a period of time. The contract term is extended by the duration of the suspension periods. Such a suspension of the contract can be requested electronically via e-mail to [email protected].
4. Liability
4.1 Each participant takes part in the lessons on his own responsibility. The course management is not liable for any personal injury and/or property damage incurred. The existence of a liability and accident insurance is assumed. The liability of the dance instructor is therefore excluded, unless the cause of damage is related to a violation of the duty of supervision and is based on intent and/or gross negligence. The participant is liable for the wardrobe or other valuables.
5. terms of payment
5.1 Participation in courses is granted to the participant against the corresponding fee:

5.2 Non-participation, early termination as well as the non-utilization of the entire lessons do not release from the payment of the entire course fee. The right to participate in the course is not transferable to third parties.
5.3 In case of an agreement period of 6 months (semester), the participant will receive discounts for events organized by Miguel Gomes Bezerra (workshops and parties in Hamburg and the surrounding area). These events will be marked accordingly on flyers and other promotional materials. The discounts do not apply to events in which Miguel Gomes Bezerra is involved but is not the exclusive main organizer.
5.4 There will be no dance classes between Christmas and New Year. The period of the summer break may vary from year to year. The dates will be communicated by the dance instructor in time. As a general rule, there will be no classes on public holidays.
5.5 The dance instructor reserves the right to cancel or substitute scheduled dance classes in necessary cases, as well as to cancel classes if enrollment is too low (less than 3 couples).
5.6 The monthly fee is due on the 5th of each month at the latest.
5.7 The amount is either to be paid via the payment system of the website www.newroots.com.br or to be transferred to the following account:

5.8 If the participant is in default of payment without good reason, the contract will be terminated at the end of the valid agreed period
6. miscellaneous
6.1 There is no guarantee that the participant will have a dance partner.6.2 There will be no refund of fees in case of culpable non-attendance at individual course dates.6.3 The participant agrees that photos and videos taken during the dance classes and dance parties may be published.
7. data protection
7.1 As required by law, we use data only internally. There is no transfer to third parties and no sale!
Also no phone numbers, emails or other data of the participants will be given out to other participants
8. entry into operation
8.1 By sending a registration form in electronic form (registration form) or by participating in any other event planned or organized by Miguel Gomes Bezerra, these terms and conditions are expressly acknowledged and bindingly accepted.
